Terms of Service

1. Overview of Services

Safe Circle Capital provides a platform that enables users to create, join, and manage rotating savings groups (“SUSU”). Contributions are linked through Plaid, processed through Checkbook.io, and verified through Persona (KYC). We are not a bank. We do not custody user funds.

2. Eligibility

1. You must be at least 18 years old
2. You must provide accurate personal, financial, and identity information
3. You must complete identity verification through Persona

3. Account Registration & Security

1. You are responsible for maintaining the confidentiality of your credentials
2. You must notify us immediately of any unauthorized account activity
3. Multiple failed KYC attempts may result in account suspension

4. Payments & Contributions

1. Group admins may set contribution amounts, schedules, and payout orders
2. Payments are processed automatically via Checkbook.io
3. Safe Circle Capital does not guarantee payouts if members fail to contribute
4. Refunds and reversals are subject to banking rules and Checkbook.io policies

5. SMS & Email Communications

By registering, you agree to receive transactional SMS and email communications, including:

1. Account verification codes
2. Payment reminders
3. Payout confirmations
4. Security alerts

Message frequency depends on group activity. Standard rates apply. You may opt out as described in our Privacy Policy.

6. Prohibited Activities

You may not use the Services to:

1. Commit fraud, money laundering, or other unlawful activity
2. Circumvent identity verification
3. Harass, mislead, or defraud other members
4. Interfere with platform security or operations

7. Dispute Resolution Between Members

Safe Circle Capital facilitates transactions but does not mediate disputes between members. We may provide transaction records upon request.

8. Limitation of Liability

1. We are not responsible for missed contributions, failed payouts, or losses due to member default
2. We are not liable for service interruptions, unauthorized access, or force majeure events
3. Our total liability is limited to the amount you paid for Services in the 12 months preceding a claim

9. Termination

We may suspend or terminate your account if you:

1. Violate these Terms
2. Fail KYC verification
3. Engage in suspicious or fraudulent behavior

10. Governing Law & Dispute Resolution

1. These Terms are governed by the laws of Rhode Island, USA
2. Any disputes shall be resolved through binding arbitration under the American Arbitration Association (AAA)

11. Changes to Terms

We may modify these Terms at any time. Updated Terms will be posted with a new Effective Date. Continued use of the Services constitutes acceptance.
